Consulta con tu asesor de <a href=\"https:\/\/www.vivendexretail.com\/\" target=\"_blank\" rel=\"noopener\">Vivendex Retail<\/a> la viabilidad de la <b data-path-to-node=\"39\" data-index-in-node=\"128\">Renuncia a la Exenci\u00f3n del IVA<\/b><span class=\"animating\">.<\/span><\/p>\n<p>La diferencia entre pagar un 10% de impuesto o un 2,5% puede financiar gran parte de la compra y reforma de tu nuevo espacio profesional.<\/p>\n<p>Te explicamos c\u00f3mo reducir la carga tributaria para aumentar la rentabilidad.<\/p>\n<h2>El IVA y el ITP en la compra de locales y oficinas<\/h2>\n<p data-path-to-node=\"5\"><span class=\"\">Los impuestos dependen de si la transacci\u00f3n es una &#8220;primera entrega&#8221; (obra nueva) o una &#8220;segunda o posterior transmisi\u00f3n&#8221; (segunda mano).<\/span><\/p>\n<h3 class=\"\" data-path-to-node=\"6\">Compra de Obra Nueva: Sujeta a IVA<\/h3>\n<p data-path-to-node=\"7\"><span class=\"\">Si compras directamente al promotor,<\/span><span class=\"\"> la operaci\u00f3n tributa obligatoriamente por el <\/span><b class=\"\" data-path-to-node=\"7\" data-index-in-node=\"82\">IVA al 21%<\/b><span class=\"\">.<\/span><\/p>\n<ul data-path-to-node=\"8\">\n<li>\n<p data-path-to-node=\"8,0,0\"><b class=\"\" data-path-to-node=\"8,0,0\" data-index-in-node=\"0\"><a href=\"https:\/\/info.vivendex.com\/retail\/oficinas-y-locales-de-negocios-para-profesionales-en-barcelona\/\">AJD en Catalu\u00f1a<\/a>:<\/b><span class=\"\"> Se suma el Impuesto de Actos Jur\u00eddicos Documentados, que cuando se renuncia a la exenci\u00f3n del IVA en compraventas que lo permitan (comprador y vendedor sean sujetos pasivos de IVA) es del <strong>3,50%<\/strong> en Catalunya.<\/span><\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"8,1,0\"><b class=\"\" data-path-to-node=\"8,1,0\" data-index-in-node=\"0\">Ventaja:<\/b><span class=\"\"> El IVA es deducible para profesionales.<\/span><\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"8,2,0\"><b class=\"\" data-path-to-node=\"8,2,0\" data-index-in-node=\"0\">Desventaja:<\/b><span class=\"\"> Exige un esfuerzo de tesorer\u00eda inicial muy elevado.<\/span><\/p>\n<\/li>\n<\/ul>\n<h3 class=\"\" data-path-to-node=\"9\">Compra de Segunda Mano: El R\u00e9gimen General (ITP)<\/h3>\n<p data-path-to-node=\"10\"><span class=\"\">Por defecto,<\/span><span class=\"\"> estas operaciones est\u00e1n exentas de IVA y tributan por el <\/span><a href=\"https:\/\/info.vivendex.com\/retail\/es-retail-impuestos-en-la-compra-de-un-local-iva-o-itp\/\"><b class=\"\" data-path-to-node=\"10\" data-index-in-node=\"70\">Impuesto de Transmisiones Patrimoniales (ITP)<\/b><\/a><span class=\"\">.<\/span><span class=\"\"> En Catalu\u00f1a,<\/span><span class=\"\"> los tipos vigentes para 2026 son:<\/span><\/p>\n<ul data-path-to-node=\"11\">\n<li>\n<p data-path-to-node=\"11,0,0\"><b class=\"\" data-path-to-node=\"11,0,0\" data-index-in-node=\"0\">10%<\/b><span class=\"\"> sobre los primeros 1.<\/span><span class=\"\">000.<\/span><span class=\"\">000 \u20ac del valor del inmueble.<\/span><\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"11,1,0\"><b class=\"\" data-path-to-node=\"11,1,0\" data-index-in-node=\"0\">11%<\/b><span class=\"\"> sobre el tramo que exceda esa cantidad.<\/span><\/p>\n<\/li>\n<\/ul>\n<blockquote class=\"\" data-path-to-node=\"12\"><p>Para un empresario, el ITP es un &#8220;coste hundido&#8221;. No se puede deducir trimestralmente; solo se recupera v\u00eda amortizaci\u00f3n contable a lo largo de d\u00e9cadas<\/p><\/blockquote>\n<h2 data-path-to-node=\"12,0\">Renuncia a la Exenci\u00f3n del IVA<\/h2>\n<p data-path-to-node=\"15\">Al\u00a0 comprar un local de segunda mano, la operaci\u00f3n suele estar exenta de IVA y tributa por ITP, de un 6-10% en Catalu\u00f1a, siendo generalmente 10% en Barcelona para importes inferiores a 1M\u20ac.<\/p>\n<p data-path-to-node=\"15\"><span class=\"\">Para optimizar el ahorro,<\/span><span class=\"\"> la ley permite que los profesionales renuncien a la <a href=\"https:\/\/info.vivendex.com\/retail\/si-vendo-un-local-en-barcelona-cuanto-tengo-que-pagar-a-hacienda\/\"><strong>exenci\u00f3n del IVA<\/strong> <\/a>en compras de segunda mano.<\/span><span class=\"\"> Esto permite pasar de un ITP del 10% (no recuperable) a un IVA del 21% (totalmente deducible).<\/span><\/p>\n<p data-path-to-node=\"16\">Requisitos para la renuncia:<\/p>\n<ol start=\"1\" data-path-to-node=\"17\">\n<li>\n<p data-path-to-node=\"17,0,0\"><b class=\"\" data-path-to-node=\"17,0,0\" data-index-in-node=\"0\">Ambas partes deben ser profesionales o empresas<\/b><span class=\"\"> en ejercicio de su actividad.<\/span><\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"17,1,0\"><b class=\"\" data-path-to-node=\"17,1,0\" data-index-in-node=\"0\">El comprador debe tener derecho a la deducci\u00f3n<\/b><span class=\"\"> total o parcial del IVA (basado en su actividad econ\u00f3mica).<\/span><\/p>\n<\/li>\n<li>Es necesario que se aplique la <strong>Inversi\u00f3n del Sujeto Pasivo (IVA\/ISP)<\/strong><\/li>\n<\/ol>\n<p data-path-to-node=\"18\">El mecanismo de Inversi\u00f3n del Sujeto Pasivo (ISP) consiste en que, a<span class=\"\">l renunciar a la exenci\u00f3n,<\/span><span class=\"\"> se activa el art\u00edculo 84.<\/span><span class=\"\">Uno.<\/span><span class=\"\">2\u00ba.<\/span><span class=\"\">e de la Ley del IVA.<\/span><span class=\"\"> Esto significa que:<\/span><\/p>\n<ul data-path-to-node=\"20\">\n<li>\n<p data-path-to-node=\"20,0,0\"><span class=\"\">El vendedor emite factura con <\/span><b class=\"\" data-path-to-node=\"20,0,0\" data-index-in-node=\"30\">IVA al 0%<\/b><span class=\"\">.<\/span><\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"20,1,0\"><span class=\"\">El comprador &#8220;autorrepercute&#8221; 20px;}}<\/style><\/div>\n<h2><\/h2>\n<h2>Ten en cuenta las amortizaciones<\/h2>\n<p>Una vez adquirido el local comercial, se puede aplicar la <b>amortizaci\u00f3n del local afecto a la actividad<\/b>, lo que permite distribuir el coste del inmueble en varios a\u00f1os y reducir el resultado fiscal.<\/p>\n<p>Para inmuebles, la amortizaci\u00f3n que aplicar anualmente sobre el valor de construcci\u00f3n es del 3%, no sobre el del terreno.<\/p>\n<p>Tambi\u00e9n se pueden amortizar las <strong>reformas, instalaciones y mejoras<\/strong>, siempre que est\u00e9n vinculadas a la
