Quan comprar per IVA i quan per ITP?<\/p>\n<p><!--more--><\/p>\n<p>Moltes vegades en la compra d&#8217;un immoble i, en especial locals comercials, naus o oficines, sorgeix el dubte sobre quin impost toca pagar, <span style=\"font-weight: bold;\">si<\/span> <span style=\"font-weight: bold;\">IVA o ITP.<\/span> El tema \u00e9s complex per\u00f2, ben gestionat, pot suposar un <span style=\"font-weight: bold;\">estalvi molt important en el cost de la compra.<\/span><\/p>\n<h2 style=\"text-align: justify;\">Impostos en la compra d&#8217;un local<\/h2>\n<p>Aquests serien els impostos que es poden generar en la <span style=\"font-weight: bold;\">compra d&#8217;un immoble<\/span> (poden ser un o diversos d&#8217;ells):<\/p>\n<ul>\n<li>Impost de Transmissions Patrimonials (ITP)<\/li>\n<li>Impost sobre el valor afegit (IVA)<\/li>\n<li>Actes Jur\u00eddics documentats (AJD)<\/li>\n<li>Gastos de Notaria, Registre, gestoria, taxacions i pr\u00e9stecs Hipotecaris.<\/li>\n<\/ul>\n<p>Per un costat, els impostos a pagar per la compra d&#8217;un immoble seran diferents depenent de si \u00e9s d&#8217;<span style=\"font-weight: bold;\">obra nova<\/span> (primera transmissi\u00f3) o de <span style=\"font-weight: bold;\">segona m\u00e0<\/span> (segones i posteriors transmissions).<\/p>\n<p style=\"text-align: justify;\">Com que s\u00f3n diversos aspectes a tenir en compte a l&#8217;hora de determinar els impostos que entren en joc en la compra d&#8217;un immoble, hem preparat una <a href=\"https:\/\/info.vivendex.com\/retail\/ca\/fiscalitat-compra-immoble\/\" rel=\"noopener\"><span style=\"color: #006a8e;\">Infografia en la qual t&#8217;expliquem els impostos que haur\u00e0s de pagar en cada tipus d&#8217;operaci\u00f3.<\/span>\u00a0<\/a><\/p>\n<h6 style=\"text-align: justify;\"><a href=\"https:\/\/info.vivendex.com\/retail\/ca\/fiscalitat-compra-immoble\/\">Fiscalitat en la compra d\u2019un immoble [Infograf\u00eda]\u00a0<\/a><\/h6>\n<h2 style=\"text-align: justify;\">Fiscalitat en la compra d&#8217;un local<\/h2>\n<p style=\"text-align: justify;\">Si s\u00f3n primeres transmissions tributen per l&#8217;impost de valor afegit (IVA), mentre que les segones transmissions tributaran per l&#8217;<a href=\"https:\/\/info.vivendex.com\/retail\/ca\/ca-es-retail-gestion-patrimonial-fraccionar-el-pagament-de-litp\/\" rel=\"noopener\">Impost de Transmissions Patrimonials (ITP).<\/a><\/p>\n<p style=\"text-align: justify;\">Existeix la possibilitat de comprar un immoble que no sigui d&#8217;obra nova sense haver d&#8217;abonar l&#8217;ITP substituint l&#8217;impost per l&#8217;IVA, <span style=\"font-weight: bold;\">sempre que les parts venedor i comprador siguin subjectes passius d&#8217;IVA.\u00a0<\/span><\/p>\n<p>Per\u00f2, per qu\u00e8 pot ser interessant renunciar a l&#8217;exempci\u00f3 de l&#8217;IVA i comprar per IVA?<\/p>\n<p style=\"text-align: justify;\">El principal motiu \u00e9s la <span style=\"font-weight: bold;\">dedu\u00efbilitat de l&#8217;impost sobre el Valor Afegit<\/span> (IVA) sobre l&#8217;Impost de Transmissions Patrimonials (ITP).<\/p>\n<p style=\"text-align: justify;\">Si ens acollim a l&#8217;exempci\u00f3 de l&#8217;IVA, la compra de l&#8217;immoble quedaria gravada per l&#8217;ITP. Per l&#8217;adquirent, empresari o professional, l&#8217;<span style=\"font-weight: bold;\">ITP li suposa un cost no dedu\u00efble<\/span> mentre que, si renuncia a l&#8217;exempci\u00f3, suportar\u00e0 un IVA que s\u00ed que podr\u00e0 deduir en la seva declaraci\u00f3 trimestral o mensual de l&#8217;IVA (model 303).<\/p>\n<p style=\"text-align: justify;\">A continuaci\u00f3, us explicarem les diferents formes en les quals podem tributar a la compra d&#8217;un immoble essent comprador i venedor <span style=\"font-weight: bold;\">subjectes passius d&#8217;IVA.<\/span><\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><em>El subjecte passiu a l&#8217;\u00e0mbit tributari \u00e9s la persona f\u00edsica o jur\u00eddica sobre la qual recau l&#8217;obligaci\u00f3 de pagar l&#8217;impost. \u00c9s a dir, el subjecte passiu de l&#8217;IVA \u00e9s la societat, empresari o professional que ven l&#8217;immoble.<\/em><\/p>\n<\/blockquote>\n<h3>Compra de l&#8217;immoble renunciant a l&#8217;exempci\u00f3 de IVA<\/h3>\n<p style=\"text-align: justify;\">Tal com disposa l&#8217;article 20. DOS de la <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1992-28740\" rel=\"noopener\">Llei d&#8217;IVA 27\/1992<\/a>, les exempcions fixades en els n\u00fameros 20\u00ba i 22\u00ba de l&#8217;apartat U de l&#8217;article 20, el subjecte passiu podr\u00e0 renunciar a l&#8217;exempci\u00f3 quan:<\/p>\n<p style=\"text-align: justify;\"><em>&#8220;Les exempcions relatives als n\u00fameros 20\u00e8 i 22\u00e8 de l&#8217;apartat anterior podran ser objecte de ren\u00fancia pel subjecte passiu, en la forma i amb els requisits que es determinin reglament\u00e0riament, quan l&#8217;adquirent sigui un subjecte passiu que actu\u00ef en l&#8217;exercici de les seves activitats empresarials o professionals i se li atribueixi el dret a efectuar la deducci\u00f3 total o parcial de l&#8217;Impost suportat en realitzar l&#8217;adquisici\u00f3 o, quan no complint-se l&#8217;anterior, en funci\u00f3 del seu dest\u00ed previsible, els b\u00e9ns adquirits vagin a ser utilitzats, totalment o parcialment, en la realitzaci\u00f3 d&#8217;operacions, que originin el dret a la deducci\u00f3\u201d<\/em><\/p>\n<div>\n<p style=\"text-align: justify;\">Amb la ren\u00fancia, <span style=\"font-weight: bold;\">la transmissi\u00f3 de l&#8217;immoble es realitzar\u00e0 per IVA<\/span> (no per ITP), per la qual cosa, el comprador podr\u00e0 reduir aquell impost (total o parcialment).<\/p>\n<\/div>\n<p style=\"text-align: justify;\">No obstant aix\u00f2, el comprador haur\u00e0 de suportar un impost addicional que si li comportar\u00e0 un cost, aquest seria l&#8217;<span style=\"font-weight: bold;\">Impost sobre Actes Jur\u00eddics Documentats<\/span> (AJD), que suposar\u00e0 entre l&#8217;1,5% i el 2,5% del valor real de l&#8217;immoble. Per\u00f2, en qualsevol cas, aquest impost seria inferior al que hauria de pagar si es tribut\u00e9s per ITP.<\/p>\n<p style=\"text-align: justify;\">Per renunciar a l&#8217;exempci\u00f3, en la mateixa\u00a0<span style=\"font-weight: normal;\"> <a href=\"\/retail\/es-retail-gestion-patrimonial\/contrato-de-compraventa\" rel=\"noopener\">escriptura de compravenda<\/a><\/span><span style=\"font-weight: normal;\"> s&#8217;ha d&#8217;incloure una cl\u00e0usula a mesura que el venedor ren\u00fancia a l&#8217;exempci\u00f3 de l&#8217;IVA i el comprador comunica que \u00e9s un subjecte passiu i que t\u00e9 dret a deduir-se total o parcialment l&#8217;IVA suportat.\u00a0<\/span><\/p>\n<h3>Compra de l&#8217;immoble mitjan\u00e7ant la inversi\u00f3 del subjecte passiu d&#8217;IVA: L&#8217;opci\u00f3 m\u00e9s interessant<\/h3>\n<p style=\"text-align: justify;\">Com hem dit abans, <span style=\"font-weight: bold;\">el subjecte passiu \u00e9s l&#8217;empresa<\/span>, empresari o professional que efectua l&#8217;entrega del b\u00e9 (el venedor) que est\u00e0 obligat a suportar l&#8217;obligaci\u00f3 tribut\u00e0ria i realitzar la liquidaci\u00f3 de l&#8217;impost, en aquest cas l&#8217;IVA.<\/p>\n<p style=\"text-align: justify;\">Amb la inversi\u00f3 del subjecte passiu, la condici\u00f3 de subjecte passiu es fa recaure en el destinatari de l&#8217;operaci\u00f3 (el comprador), en lloc del qual el ven, que \u00e9s el m\u00e9s habitual en l&#8217;IVA.<\/p>\n<p style=\"text-align: justify;\">La inversi\u00f3 del subjecte passiu es pot produir en diferents operacions, per\u00f2 la que ens interessa en aquest moment \u00e9s la referent a entregues de b\u00e9ns immobles exemptes a les que es refereixen els apartats 20.\u00ba i 22.\u00ba de l&#8217;article 20 U de la Llei d&#8217;IVA en les que el subjecte passiu hagu\u00e9s renunciat a l&#8217;exempci\u00f3.<\/p>\n<p style=\"text-align: justify;\">En aquest cas, <span style=\"font-weight: bold;\">la condici\u00f3 de subjecte passiu s&#8217;inverteixi i recaigui sobre el que compra<\/span>, per tant, l&#8217;emissor de la factura ho far\u00e0 sense IVA i no haur\u00e0 de repercutir-ho. A m\u00e9s, haur\u00e0 d&#8217;indicar a la factura que \u00e9s una operaci\u00f3 d&#8217;Inversi\u00f3 en subjecte passiu segons <a href=\"https:\/\/noticias.juridicas.com\/base_datos\/Fiscal\/l37-1992.t6.html\" rel=\"noopener\">l&#8217;article 84 de la Llei d&#8217;IVA.<\/a><\/p>\n<h4 style=\"text-align: justify;\">Com acollir-se a la inversi\u00f3 del subjecte passiu<\/h4>\n<ol>\n<li style=\"text-align: justify;\">El venedor<span style=\"font-weight: bold;\"> emet la factura sense IVA<\/span>, i per tant, no haur\u00e0 d&#8217;ingressar-ho.<\/li>\n<li style=\"text-align: justify;\">El comprador, per la seva part, <span style=\"font-weight: bold;\">rep la factura sense IVA<\/span> i haur\u00e0 d&#8217;autorepercutir-la, \u00e9s a dir, reportar-ho i suportar-ho, a la seva declaraci\u00f3 trimestral.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">El venedor haur\u00e0 de reflectir aquestes quantitats en el model 303 en l&#8217;\u00e0mbit informatiu en l&#8217;apartat d'&#8221;<span style=\"font-weight: bold;\">operacions no subjectes o amb inversi\u00f3 del subjecte passiu que originen el dret a la deducci\u00f3<\/span>&#8221;, traslladant la suma de les quantitats reflectides al model 303, al model 390 a l&#8217;apartat d'&#8221;operacions no subjectes per regles de localitzaci\u00f3 o amb inversi\u00f3 del subjecte passiu&#8221;.<\/p>\n<p style=\"text-align: justify;\">Per la seva part, el comprador i receptor de la factura ser\u00e0 el subjecte passiu de l&#8217;impost, havent de registrar la factura rebuda amb inversi\u00f3 de subjecte passiu, de manera que la seva base imposable es declari en el model 303, dins de l&#8217;IVA reportat, en les caselles 12 i 13 del model i en les caselles que correspongui dins de l&#8217;IVA dedu\u00efble.<\/p>\n<ul>\n<li style=\"text-align: justify;\"><a href=\"https:\/\/2772937.fs1.hubspotusercontent-na1.net\/hubfs\/2772937\/descargables\/MODELO%20FACTURA%20INVERSION%20SUJETO%20PASIVO%20IVA.pdf\" target=\"_blank\" rel=\"noopener\">Veure Model de Factura de subjecte passiu de l&#8217;IVA &gt;&gt;<\/a><\/li>\n<\/ul>\n<p>Resumint, mitjan\u00e7ant aquesta f\u00f3rmula, el <strong>comprador no ha de pagar l&#8217;ITP i tampoc desembossar l&#8217;import d&#8217;IVA,<\/strong> ja que queda compensat.<\/p>\n<p style=\"text-align: justify;\">L&#8217;\u00fanic cost ser\u00eda el de l&#8217;Impost d&#8217;Actes Jur\u00eddics Documentats que ser\u00eda entre el 1,5% i el 2,5% del valor real de l&#8217;immoble.<\/p>\n<p style=\"text-align: justify;\">A l&#8217;escriptura de compravenda s&#8217;ha d&#8217;incloure una <span style=\"font-weight: bold;\">cl\u00e0usula renunciant a l&#8217;exempci\u00f3 d&#8217;IVA\u00a0<\/span><span style=\"font-weight: normal;\">i a m\u00e9s que en conformitat a l&#8217;article 84.u.2.e de la Llei d&#8217;IVA 37\/1.992, en la seva redacci\u00f3 donada per la Llei 7\/2012, ser\u00e0 subjecte passiu l&#8217;adquirent.<\/span><\/p>\n<p style=\"text-align: justify;\">Si despr\u00e9s de tot aix\u00f2 encara tens dubte sobre quin impost haur\u00e0s de pagar en el teu cas (IVA o ITP) hem preparat una Infografia en la qual et resumim aquesta informaci\u00f3 i en la que t&#8217;expliquem <a href=\"https:\/\/info.vivendex.com\/retail\/ca\/fiscalitat-compra-immoble\/\" rel=\"noopener\">quina tassa aplicar a cada tipus d&#8217;operaci\u00f3.<\/a><\/p>\n<h6 style=\"text-align: justify;\"><a href=\"https:\/\/info.vivendex.com\/retail\/ca\/fiscalitat-compra-immoble\/\">Fiscalitat en la compra d\u2019un immoble [Infograf\u00eda]\u00a0<\/a><\/h6>\n<p style=\"text-align: justify;\">De totes maneres, si vols descobrir quina via de tributaci\u00f3 et resultar\u00e0 m\u00e9s rentable, pots consultar amb l&#8217;equip de Vivendex.
