{"id":2252,"date":"2021-09-17T16:53:09","date_gmt":"2021-09-17T14:53:09","guid":{"rendered":"https:\/\/info.vivendex.com\/retail\/vendre-local-comercial-que-esta-de-lloguer\/"},"modified":"2021-09-17T16:53:09","modified_gmt":"2021-09-17T14:53:09","slug":"vendre-local-comercial-que-esta-de-lloguer","status":"publish","type":"post","link":"https:\/\/info.vivendex.com\/retail\/ca\/vendre-local-comercial-que-esta-de-lloguer\/","title":{"rendered":"Vendre local comercial que est\u00e0 de lloguer"},"content":{"rendered":"<p style=\"text-align: justify;\">Si est\u00e0 pensant a <strong>vendre local comercial<\/strong> a Barcelona, \u200b\u200bi estigui el t\u00e9 llogat, est\u00e0 obligat legalment a oferir-li-ho en <strong>venda<\/strong> a l&#8217;arrendatari en primer lloc, indicant-li el preu i la resta de condicions.<\/p>\n<p style=\"text-align: justify;\">L&#8217;inquil\u00ed, per part seva, disposar\u00e0 d&#8217;un dret d&#8217;adquisici\u00f3 preferent o de <strong>tempteig<\/strong> i comptar\u00e0 amb un termini de 30 dies per optar per la compra.  <!--more--><\/p>\n<p style=\"text-align: justify;\">Si el propietari no fa l&#8217;oferiment del local a l&#8217;arrendatari, el ven per un preu inferior al comunicat, o incompleix qualsevol dels requisits, l&#8217;inquil\u00ed pot <strong>impugnar<\/strong> la <strong>venda<\/strong> i adquirir el local en les mateixes condicions en qu\u00e8 el propietari el va transmetre a un tercer; aquest dret s&#8217;anomena dret de <strong>retracte<\/strong> i l&#8217;inquil\u00ed el pot exercir en un termini de 30 dies des que se li notifiqui la venda del local.<\/p>\n<p style=\"text-align: justify;\">L&#8217;inquil\u00ed no disposar\u00e0 dels drets de <strong>tempteig<\/strong> i <strong>retracte<\/strong> quan el local arrendat es vengui de manera conjunta amb la resta de locals o habitatges propietat de l&#8217;arrendador que formin part d&#8217;un mateix immoble, ni tampoc quan els diferents propietaris d&#8217;un immoble venguin a un mateix comprador la totalitat dels pisos i locals que el componen.<\/p>\n<p style=\"text-align: justify;\">Per part seva, la persona que compra un local que es troba arrendat, adquireix igualment els mateixos <strong>drets<\/strong> i <strong>obligacions<\/strong> que tenia l&#8217;arrendador, per la qual cosa est\u00e0 obligada a respectar les condicions del contracte d&#8217;arrendament fins que aquest s&#8217;extingeixi.<\/p>\n<p style=\"text-align: justify;\">Com passa amb la resta dels drets establerts a la LAU per als contractes d&#8217;arrendament de local de negoci, les parts poden <a href=\"https:\/\/info.vivendex.com\/retail\/es-retail-clausula-de-renuncia-en-los-contratos-de-arrendamiento-es-validad\/\">pactar la ren\u00fancia<\/a> a aquest dret o modificar-lo segons els convingui, sempre tenint en compte el par\u00e0graf 8\u00e8 de l&#8217;article 25 <em>\u201c8\u2026\u2026. trenta dies a la data de formalitzaci\u00f3 del contracte de compravenda.\u201d<\/em> .
