La successi\u00f3 heredit\u00e0ria\u00a0estableix el dest\u00ed que han de tenir les titularitats i relacions jur\u00eddiques de la persona morta. Sobre els b\u00e9ns del mort existeixen drets reals, de cr\u00e8dit i tamb\u00e9 recauen obligacions i c\u00e0rregues.<\/p>\n

Si el mort va deixar testament, aquest ha de respectar la leg\u00edtima de descendents i ascendents. En cas de no tenir descendents, del c\u00f2njuge. Si no va deixar testament, l’her\u00e8ncia \u00e9s per als parents -esmentats en ordre- i en cas de no tenir, a l’Estat.<\/p>\n

Tamb\u00e9 \u00e9s important tenir en compte que existeix un\u00a0termini de sis mesos per a pagar\u00a0l’Impost de Successions<\/a>\u00a0que recapta l’administraci\u00f3 d’hisenda de cada Comunitat Aut\u00f2noma a Espanya.<\/p>\n

Quants habitatges s’han transm\u00e8s en her\u00e8ncia en 2022?<\/h3>\n

Segons les dades de l’INE, en els primers sis mes de l’any es van transmetre en her\u00e8ncia uns 118.421 habitatges. Cal destacar que el mes de mar\u00e7 va aconseguir m\u00e0xims hist\u00f2rics amb 19.649 transaccions, si comparem amb les 12.669 transaccions registrades des que va comen\u00e7ar el 2007.<\/p>\n

Quant a les\u00a0comunitats on s’han transm\u00e8s m\u00e9s habitatges per her\u00e8ncia\u00a0durant el primer semestre de l’any 2022, Andalusia (20.727), Catalunya (17.851), Comunitat Valenciana (17.048) i Madrid (13.705) destaquen per sobre de la resta.<\/p>\n

Castella i Lle\u00f3 (7.250), Pa\u00eds Basc (6.173), Gal\u00edcia (5.854), Castella-la Manxa (5.601) presenten gaireb\u00e9 la meitat que les anteriors esmentades i amb xifres considerablement m\u00e9s baixes, es troben Arag\u00f3 (3.943), Extremadura (3.416), Ast\u00faries (3.360), Can\u00e0ries (3.166), Murcia (3.020), Balears (2.019), Navarra (1.941), Cant\u00e0bria (1.845), La Rioja (1.286), Ceuta (142) i Melilla (84).<\/p>\n

No obstant aix\u00f2, existeix una lleugera baixada respecte al 2021, any en qu\u00e8 es van batre r\u00e8cords tant en el nombre d’her\u00e8ncies tramitades a Espanya, com en la quantitat de ren\u00fancies sobre aquestes transmissions.<\/p>\n

Una moderaci\u00f3 gradual: els hereus renuncien a l’her\u00e8ncia<\/h3>\n

La situaci\u00f3 actual \u00e9s que continua havent-hi un exc\u00e9s d’her\u00e8ncies bastant notable, a causa de la gran quantitat de defuncions que va haver-hi durant el 2020. En conseq\u00fc\u00e8ncia, les ren\u00fancies tamb\u00e9 han augmentat, principalment per l’alta c\u00e0rrega fiscal o els deutes que\u00a0s’heretaran.<\/p>\n
