Amb les noves modificacions, el venedor adquireix l'obligaci\u00f3 expressa de <strong>transmetre la titularitat<\/strong> del domini o dret del b\u00e9 de qu\u00e8 es tracti.<\/p>\n<h3>Conformitat<\/h3>\n<p>En el nou Codi Civil de Catalunya, hi ha tota una subsecci\u00f3 que regula la conformitat de l'immoble transm\u00e8s (arts. 62120 a 621-30). Aquesta subsecci\u00f3, pret\u00e9n substituir el tradicional sanejament dels articles 1474-1499 del Codi Civil.<\/p>\n<p>Segons la nova normativa, l'immoble lliurat <strong>ha de correspondre's amb el que estableix el propi contracte<\/strong> i amb els criteris avalats per la Llei per determinar si existeix o no la conformitat. Per aix\u00f2, es valoraran aspectes relacionats amb:<\/p>\n<ul>\n<li>L'adequaci\u00f3 de la <strong>descripci\u00f3<\/strong> de l'immoble realitzada pel venedor.<\/li>\n<li>L'immoble ha de ser idoni per a l'<strong>\u00fas habitual<\/strong> a qu\u00e8 es destini o s'hagi acordat en el contracte.<\/li>\n<li>La propietat ha de tenir les <strong>qualitats i prestacions habituals<\/strong> que el comprador pot esperar d'ella d'acord amb la seva naturalesa.<\/li>\n<li>L'habitatge ha de tenir les prestacions exhibides pel venedor.<\/li>\n<\/ul>\n<h3>Deure d'informaci\u00f3<\/h3>\n<p>A m\u00e9s de l'obligaci\u00f3 de conformitat, l'article 621-7 del nou Codi Civil a Catalunya estableix que el venedor est\u00e0 en l'obligaci\u00f3 de facilitar tota la informaci\u00f3 rellevant sobre l'immoble que es va a transmetre i a actuar d'acord amb la <strong>bona fe i l'honradesa<\/strong> de tractes.<\/p>\n<p>D'aquesta manera, el lliurament del <strong>certificat d'efici\u00e8ncia energ\u00e8tica<\/strong> esdev\u00e9 un requisit indispensable per poder procedir amb la signatura.<\/p>\n<h3>Exclusi\u00f3 de Responsabilitat<\/h3>\n<p>El venedor no respondr\u00e0 de la<strong> manca de conformitat<\/strong> que el comprador conegui, o que raonablement no podia ignorar en el moment de la realitzaci\u00f3 del contracte.<\/p>\n<p>De la mateixa manera, si que respondr\u00e0 en els casos d'ocultaci\u00f3, neglig\u00e8ncia greu o garantia expressa de conformitat.<\/p>\n<h3>Contracte d'arres<\/h3>\n<p>S'estableix clarament la <strong>distinci\u00f3 entre arres<\/strong> confirmat\u00f2ries i arres penitencials, establint-se que les primeres tenen car\u00e0cter general i es donen per fet mentre que no es manifesti el contrari, i les penitencials tenen car\u00e0cter excepcional i s'han d'acordar de manera expressa.<\/p>\n<p>Si tens dubtes relacionats amb aquests termes, pots llegir el nostre article <a href=\"https:\/\/info.vivendex.com\/ca\/diferencies-entre-un-contracte-de-compravenda-i-un-contracte-darres\/\" target=\"_blank\" rel=\"noopener\"><strong>Difer\u00e8ncies entre contracte de Compravenda i Contracte d'Arres.<\/strong><\/a><\/p>\n<h3>Preu<\/h3>\n<p>Una de les grans novetats que el sis\u00e8 llibre del Codi Civil de Catalunya preveu en relaci\u00f3 als contractes privats de compravenda, \u00e9s la no<strong> necessitat de fixar un preu exacte<\/strong> en el contracte.<\/p>\n<p>Amb la nova legislaci\u00f3, s'estableixen altres maneres de procedir per determinar el preu en cas que aquest no estigui fixat expressament.
