En la nostra societat, existeixen <strong>tres r\u00e8gims o societats matrimonials diferents<\/strong>:<\/p>\n<ul>\n<li>R\u00e8gim de guanys<\/li>\n<li>R\u00e8gim de participaci\u00f3<\/li>\n<li>Separaci\u00f3 de b\u00e9ns<\/li>\n<\/ul>\n<p>Encara que en la majoria de les comunitats aut\u00f2nomes el r\u00e8gim matrimonial per defecte (\u00e9s a dir, el que s&#8217;atorga tret que s&#8217;especifiqui el contrari) \u00e9s la societat de guanys, a Catalunya el r\u00e8gim establert per defecte \u00e9s la separaci\u00f3 de b\u00e9ns.<\/p>\n<p><strong>Per\u00f2, quina consideraci\u00f3 tenen les her\u00e8ncies en un r\u00e8gim de guanys?<\/strong><\/p>\n<h6>El Codi Civil, en el seu article 1.346, qualifica com b\u00e9 privatiu aquell que ha estat adquirit pel c\u00f2njuge a t\u00edtol gratu\u00eft.<\/h6>\n<p>Aix\u00f2 vol dir que els immobles o qualsevol altre b\u00e9 o quantitat econ\u00f2mica que es rebi com a her\u00e8ncia, <strong>tindran car\u00e0cter privatiu<\/strong>. En cas contrari, esdevindria m\u00e9s complicat determinar quin \u00e9s el romanent que procedeix de manera exclusiva de l'her\u00e8ncia.<\/p>\n<p>Si despr\u00e9s de vendre un habitatge heretat, l'hereu desitja invertir els diners obtinguts en un nou habitatge, aquesta podr\u00e0 continuar tenint la consideraci\u00f3 de b\u00e9 privatiu. No obstant aix\u00f2, ser\u00e0 necessari indicar amb exactitud la proced\u00e8ncia dels diners utilitzats per a la compra en el moment de la <a href=\"https:\/\/info.vivendex.com\/ca\/com-vendre-un-pis-heretat-a-barcelona\/?hsLang=ca\" target=\"_blank\" rel=\"noopener\"><strong>signatura en el Notari<\/strong><\/a>.<\/p>\n<h2>I si llogo un pis heretat estant en societat de guanys?<\/h2>\n<p>Segons l'article 1.347 del Codi Civil, \"<em>els fruits, rendes o interessos que produeixin tant els b\u00e9ns privatius com els de guanys, tindran car\u00e0cter de guanys<\/em>\".<\/p>\n<p>Aix\u00f2 vol dir, que <strong>les rendes obtingudes pel lloguer d'un pis heretat seran ingressades al r\u00e8gim de guanys.<\/strong> En aquest cas, en el moment de liquidar la societat de guanys (divorci, defunci\u00f3...), cada c\u00f2njuge hauria de rebre el 50% de les rendes obtingudes per l'habitatge.<\/p>\n<h2>Assessorament immobiliari en cas d'her\u00e8ncia<\/h2>\n<p>Com has pogut observar, el tipus de r\u00e8gim triat en el matrimoni, l'exist\u00e8ncia de testament o la destinaci\u00f3 que se li vagi a atorgar a l'habitatge heretat (venda o lloguer), tindr\u00e0 incid\u00e8ncia a l'hora de determinar qui \u00e9s el beneficiari de la rendibilitat obtinguda per la propietat heretada.<\/p>\n<p>Per aquest motiu, si has de<strong>\u00a0vendre o llogar un pis heretat a Barcelona<\/strong>, et recomanem que et posis en mans de professionals.
