No obstant aix\u00f2, cal tenir en compte que cada r\u00e8gim de protecci\u00f3, cada ajuntament i fins i tot cada promoci\u00f3, pot establir condicions particulars dins les seves compet\u00e8ncies. Realitzar una sol\u00b7licitud<\/span><\/h2>\n<p>El primer pas per poder llogar un habitatge de protecci\u00f3 oficial, ser\u00e0 realitzar la sol\u00b7licitud pertinent.<\/p>\n<p>L&#8217;esmentada sol\u00b7licitud, ha de ser realitzada pel titular o els titulars de l&#8217;habitatge. A la\u00a0sol\u00b7licitud , s&#8217;han d&#8217;explicar els motius pels quals l&#8217;habitatge ja no pot ser utilitzat com habitual i permanent (trasllat per treball, augment de membres de la unitat familiar etc.), i, per tant, es sol\u00b7licita l\u00b4autoritzaci\u00f3 per poder llogar-la.<\/p>\n<p>La sol\u00b7licitud s&#8217;ha de presentar de manera presencial a l&#8217;Ag\u00e8ncia de l&#8217;Habitatge de Catalunya i Serveis territorials, o b\u00e9 a les oficines locals de l&#8217;habitatge.<\/p>\n<h2><span style=\"color: #000000;\">2. Documentaci\u00f3 a presentar<\/span><\/h2>\n<p><span style=\"font-family: helvetica;\">Juntament amb aquesta sol\u00b7licitud, s&#8217;ha d&#8217;adjuntar la documentaci\u00f3 seg\u00fcent:<\/span><\/p>\n<p><span style=\"font-family: helvetica;\">&#8211; DNI dels titulars de l&#8217;habitatge<\/span><br \/>\n<span style=\"font-family: helvetica;\">&#8211; Original i fotoc\u00f2pia o fotoc\u00f2pia compulsada de les escriptures de l&#8217;habitatge.<\/span><br \/>\n<span style=\"font-family: helvetica;\">&#8211; Justificant dels motius pels quals es sol\u00b7licita l&#8217;autoritzaci\u00f3.<\/span><\/p>\n<p><span style=\"font-family: helvetica;\">&#8211; Certificat de l\u00b4entitat banc\u00e0ria on consti la data de la formalitzaci\u00f3 del pr\u00e9stec, en cas de que existeixi.<\/span><\/p>\n<h2><span style=\"color: #000000;\">3. Resposta de l&#8217;Administraci\u00f3<\/span><\/h2>\n<p>L&#8217;Administraci\u00f3 emetr\u00e0 la seva resposta en funci\u00f3 de la normativa per la qual es va qualificar l&#8217;habitatge. El servei competent ha de comunicar a la persona interessada si es concedeix l&#8217;autoritzaci\u00f3 per al lloguer de l&#8217;habitatge protegit i sota quines condicions. En alguns casos, l&#8217;Administraci\u00f3 requerir\u00e0 la devoluci\u00f3 de les quantitats concedides en concepte d&#8217;ajuda a l&#8217;adquisici\u00f3 o d\u00b4altres beneficis legals.<\/p>\n<p>A la resposta emesa per l&#8217;Administraci\u00f3, podr\u00e0 trobar-se informaci\u00f3 relativa a:<\/p>\n<ul>\n<li>Renda m\u00e0xima de lloguer<\/li>\n<li>Termini m\u00e0xim del lloguer<\/li>\n<\/ul>\n<p>Tamb\u00e9 es poden establir requisits per als nous llogaters com:<\/p>\n<ul>\n<li>Pertinen\u00e7a al Registre de Sol\u00b7licitants d&#8217;Habitatges de Protecci\u00f3 Oficial.<\/li>\n<li>Renda inferior a X vegades l&#8217;Indicador de Renda de Sufici\u00e8ncia de la Generalitat. Per justificar els ingressos, caldr\u00e0 aportar una declaraci\u00f3 jurada que no s\u00f3n propietaris de cap altre habitatge de HPO i la seva \u00faltima declaraci\u00f3 de la renda.<\/li>\n<li>Contracte de lloguer visat per l&#8217;Ag\u00e8ncia de l&#8217;Habitatge de Catalunya. Si no es presenta el contracte de lloguer en 6 mesos, es revoca l&#8217;autoritzaci\u00f3.<\/li>\n<\/ul>\n<p>El contracte de lloguer em\u00e8s sobre l&#8217;habitatge protegit, haur\u00e0 de contenir la seg\u00fcent informaci\u00f3 perqu\u00e8 sigui considerat v\u00e0lid:<\/p>\n<ul>\n<li>Identificaci\u00f3 de l&#8217;expedient de construcci\u00f3 de la promoci\u00f3 de l&#8217;habitatge p\u00fablic de l&#8217;immoble i la seva data de qualificaci\u00f3 definitiva com a habitatge de protecci\u00f3 oficial.<\/li>\n<li>Renda de lloguer pactada entre l\u00b4arrendador i l\u00b4arrendatari (sota els m\u00e0xims de l&#8217;Administraci\u00f3).<\/li>\n<li>Comprom\u00eds per part dels inquilins de destinar l&#8217;habitatge protegit com a domicili habitual.<\/li>\n<li>Comprom\u00eds per part dels inquilins d&#8217;ocupar l&#8217;habitatge en un termini m\u00e0xim de 3 mesos des de la posada a disposici\u00f3.<\/li>\n<\/ul>\n<p>En cas que l&#8217;autoritzaci\u00f3 per al lloguer sigui denegada, es podr\u00e0 presentar un recurs d&#8217;al\u00e7ada davant el Director de Promoci\u00f3 de l&#8217;Habitatge de l&#8217;Ag\u00e8ncia de l&#8217;Habitatge de Catalunya en funci\u00f3 dels articles 114 i 115 de la Llei 30\/1992, del 26 de novembre.<\/p>\n<h2>I si el que vull \u00e9s vendre?<\/h2>\n<p>Per <strong>vendre un habitatge de protecci\u00f3 oficial a Barcelona<\/strong> sense que hagi transcorregut el per\u00edode establert per l&#8217;Administraci\u00f3 perqu\u00e8 perdi la seva condici\u00f3 de protegida, haur\u00e0s de portar a terme un proc\u00e9s de desqualificaci\u00f3 per a la venda.
