Quan una persona mor sense haver plasmat les seves voluntats mitjan\u00e7ant un testament, s’obre el que s’anomena comunament com la intestada<\/strong>. Les her\u00e8ncies a Catalunya es regeixen sota el que estipula l’article 442-1 del Codi Civil de Catalunya.<\/strong><\/a><\/p>\n

Segons aquest article, l’ordre a l’hora d’establir els hereus d’una her\u00e8ncia sense testament,<\/strong> seria el seg\u00fcent:<\/p>\n

1er Descendents<\/h3>\n

Segons la llei que regula les her\u00e8ncies sense testament a Catalunya, els fills seran els principals hereus<\/strong>. Si aquests no poguessin heretar perqu\u00e8 han mort o perqu\u00e8 un jutge els ha declarat absents o indignes, seran els descendents d’aquests els que encap\u00e7alin l’ordre hereditari. En qualsevol cas, es mantindria fora de perill el dret del vidu o la v\u00eddua a l’usdefruit universal de l’her\u00e8ncia.<\/strong><\/p>\n

2on C\u00f2njuge o parella de fet<\/h3>\n

Si el difunt mor sense haver deixat fills o altres descendents, l’hereu passaria a ser el c\u00f2njuge vidu o la parella de fet del difunt.<\/strong> Si en el moment de la defunci\u00f3 el difunt es trobava en tr\u00e0mits de separaci\u00f3 o divorci, la persona v\u00eddua o parella de fet perdria el seu dret a her\u00e8ncia. En qualsevol cas, els pares conservarien el dret a la lleg\u00edtima.<\/strong><\/p>\n

3er Ascendents de primer grau<\/h3>\n

En una her\u00e8ncia sense testament a Catalunya, si el difunt mor sense descendents (fills o n\u00e9ts), i sense c\u00f2njuge o parella de fet, els hereus seran els seus pares a parts iguals<\/strong>. En el cas que nom\u00e9s quedi un dels dos progenitors amb vida, aquest ser\u00e0 el que hereti tot el patrimoni.<\/p>\n

4rt Ascendents de segon i tercer grau<\/h3>\n

Un cop descartats els descendents (fills i n\u00e9ts) i el c\u00f2njuge o parella de fet com a hereus, si, a m\u00e9s no hi ha ascendents de primer grau (pares), l’her\u00e8ncia recaur\u00e0 en mans dels avis<\/strong> (ascendents de segon grau) o besavis<\/strong> (ascendents de tercer grau) del mort.<\/p>\n

Si s’han concl\u00f2s les l\u00ednies d’ascendents i descendents i no s’han trobat hereus vius capa\u00e7os d’acceptar l’her\u00e8ncia, s’acudir\u00e0 a la l\u00ednia de parents col\u00b7laterals del mort: germans, nebots, oncles i cosins germans.<\/strong><\/p>\n

6\u00e8 Generalitat de Catalunya<\/h3>\n

Finalment, la Generalitat de Catalunya ser\u00e0 la benefici\u00e0ria del patrimoni del mort<\/strong> en cas que no es trobin familiars dins de l’ordre de successi\u00f3 establert per la llei capa\u00e7os d’acceptar l’her\u00e8ncia. L’Administraci\u00f3 sempre ocupa l’\u00faltim lloc en l’ordre d’hereus.<\/p>\n
