Escriptures de Compravenda<\/h2>\n<p>La prova m\u00e9s evident per demostrar una venda a p\u00e8rdues, \u00e9s sens dubte acudir a les <strong>Escriptures de l'immoble.<\/strong>\u00a0A tal fi hem de documentar la minusvalidesa amb una c\u00f2pia de les Escriptures amb les que al seu dia vam adquirir l'habitatge, i una altra c\u00f2pia de les Escriptures amb qu\u00e8 transmetrem el pis\u00a0als seus nous propietaris.<\/p>\n<h2 data-fontsize=\"22\" data-lineheight=\"27\">2. Valors de refer\u00e8ncia<\/h2>\n<p>El mes de gener finalitzava amb una nova sent\u00e8ncia del Suprem admetent els<strong> valors de refer\u00e8ncia publicats per cada comunitat aut\u00f2noma<\/strong> com a prova per a demostrar una venda a p\u00e8rdues. Els valors de refer\u00e8ncia emprats, seran els mateixos que els usats per a la valoraci\u00f3 dels b\u00e9ns immobles a l'efecte de l'Impost de Transmissions Patrimonials i Actes Jur\u00eddics Documentats i sobre <a href=\"https:\/\/info.vivendex.com\/ca\/limpost-de-successions-a-catalunya\/?hsLang=ca\" target=\"_blank\" rel=\"noopener\"><strong>Successions i Donacions.<\/strong><\/a><\/p>\n<p>Podeu consultar els valors de refer\u00e8ncia per al c\u00e0lcul d'aquests impostos, a la p\u00e0gina de la <a href=\"https:\/\/atc.gencat.cat\/ca\/normativa-i-criteris\/valoracions-immobiliaries\/la-valoracio-dels-bens-immobles-a-catalunya\/index.html\" target=\"_blank\" rel=\"noopener\"><strong>Generalitat de Catalunya.<\/strong><\/a><\/p>\n<h2 data-fontsize=\"22\" data-lineheight=\"27\">3. Actualitzacions de p\u00e8rdues conforme a l'IPC<\/h2>\n<p>Cada vegada s\u00f3n m\u00e9s els jutjats que admeten <strong>actualitzar els valors de la transmissi\u00f3 d'acord amb l'IPC<\/strong> perqu\u00e8 el venedor pugui obtenir una p\u00e8rdua per la venda i, conseq\u00fcentment, evitar el pagament de l'impost.<\/p>\n<p><strong>Exemple<\/strong>:<\/p>\n<p>Un immoble comprat el febrer de 2001 per 140.000 euros i venut per 180.000 euros al febrer de 2018, pot haver experimentat una p\u00e8rdua de valor si actualitzem els preus en funci\u00f3 de l'IPC.<\/p>\n<h2 data-fontsize=\"22\" data-lineheight=\"27\">4. Incloure despeses d'urbanitzaci\u00f3 del terreny<\/h2>\n<p>Una altra estrat\u00e8gia per evitar el pagament de la Plusv\u00e0lua Municipal, \u00e9s incloure les despeses d'urbanitzaci\u00f3 del terreny <strong>per incrementar el valor d'adquisici\u00f3<\/strong>. Aquesta estrat\u00e8gia, va ser admesa per un Tribunal Superior de Just\u00edcia de Castella i Lle\u00f3 i actualment es troba pendent de resoluci\u00f3 per part del Tribunal Suprem.<\/p>\n<h2 data-fontsize=\"22\" data-lineheight=\"27\">5. Incloure despeses de compravenda<\/h2>\n<p>Un altre argument adm\u00e8s per un Tribunal Superior de Just\u00edcia de Castella i Lle\u00f3, va ser incloure els <strong>costos de notaria, registre i impostos<\/strong> per al c\u00e0lcul del valor d'adquisici\u00f3 de l'immoble. D'aquesta manera, demostrar una p\u00e8rdua de valor seria m\u00e9s senzill ja que partir\u00edem d'un valor de compra inicial m\u00e9s elevat.<\/p>\n<p>Tant l'Impost de Societats com l'IRPF, permet als contribuents afegir aquests costos al valor de la compravenda per determinar si existeix o no un guany.<\/p>\n<h2 data-fontsize=\"22\" data-lineheight=\"27\">6.
