Quina consideraci\u00f3 tindria l&#8217;habitatge objecte de la transacci\u00f3? Per determinar-ho haurem de respondre a les seg\u00fcents q\u00fcestions:<\/p>\n<h4>Es tracta de l&#8217;habitatge familiar?<\/h4>\n<p>Si el pis en q\u00fcesti\u00f3 <strong>es el domicili habitual<\/strong> de la parella, l&#8217;habitatge no tindr\u00e0 consideraci\u00f3 de privatiu en exclusiva d&#8217;aquell que al seu dia el va adquirir, sin\u00f3 que correspondr\u00e0 proindiv\u00eds a la societat de guanys i al c\u00f2njuge que la va adquirir en proporci\u00f3 al valor que cadasc\u00fa hagi aportat.<\/p>\n<p>En aquest cas, l&#8217;habitatge tindr\u00e0 una doble naturalesa, <strong>d&#8217;una banda ser\u00e0 privatiu<\/strong> del c\u00f2njuge que en el seu dia el va comprar en el percentatge pagat abans de contraure matrimoni i <strong>d&#8217;altra banda tindr\u00e0 consideraci\u00f3 de guanys<\/strong> en el percentatge en qu\u00e8 hagi estat pagat amb diners de guanys .<\/p>\n<p>No obstant, si l&#8217;habitatge en q\u00fcesti\u00f3 <strong>no t\u00e9 la consideraci\u00f3 de domicili habitual<\/strong> (imaginem-nos una segona resid\u00e8ncia a la platja) aquest s\u00ed que tindr\u00e0 car\u00e0cter privatiu tot i que la seva totalitat o part del pis hagin estat pagats amb diners de guanys, tot aix\u00f2 sense perjudici del dret de reemborsament que pugui correspondre a la societat de guanys mitjan\u00e7ant el reintegrament del seu import actualitzat al moment de la liquidaci\u00f3.<\/p>\n<h4>I si s&#8217;utilitzen els diners obtinguts en la venda per comprar un nou habitatge?<\/h4>\n<p>Tamb\u00e9 podria donar-se el cas que un membre de la parella hagi venut un habitatge privatiu i decideixi invertir els diners obtinguts en la compra d&#8217;un nou habitatge. En aquest cas, <strong>es considerar\u00e0 el nou habitatge com un b\u00e9 privatiu<\/strong> del c\u00f2njuge a qui pertanyen els diners.<\/p>\n<p>Tot i aix\u00f2, i segons l&#8217;article 1355 del Codi Civil:<\/p>\n<p><em>Podran els c\u00f2njuges, de com\u00fa acord, atribuir la condici\u00f3 de guanys als b\u00e9ns que adquireixin a t\u00edtol oner\u00f3s durant el matrimoni, sigui quina sigui la proced\u00e8ncia del preu o contraprestaci\u00f3 i la forma i terminis en qu\u00e8 se satisfaci.<\/em><\/p>\n<p>Aix\u00f2 vol dir que els c\u00f2njuges podran atribuir de mutu acord car\u00e0cter de guanys a l&#8217;habitatge adquirit amb diners privatius si aix\u00ed ho desitgen.<\/p>\n<h4>Vendre un habitatge heretat en r\u00e8gim de societat de guanys<\/h4>\n<p>El mateix passa quan un dels c\u00f2njuges rep un habitatge heretat.
