Cada ag\u00e8ncia o agent utilitza la seva pr\u00f2pia versi\u00f3, adaptada als seus m\u00e8todes i condicions de treball. No obstant aix\u00f2, aquesta diversitat de formats, unida al coneixement legal limitat que sovint tenen els clients, pot donar lloc a situacions injustes i fins i tot contr\u00e0ries a la normativa vigent.<\/p>\n<p>Per evitar aquest tipus de situacions i dur a terme una compravenda segura, a continuaci\u00f3 analitzarem els elements essencials que ha de contenir un contracte d\u2019intermediaci\u00f3 immobili\u00e0ria, les cl\u00e0usules que poden considerar-se abusives i <strong>com protegir-te davant pr\u00e0ctiques deslleials<\/strong> durant una operaci\u00f3 immobili\u00e0ria.<\/p>\n<h2>Qu\u00e8 \u00e9s un contracte d\u2019intermediaci\u00f3 immobili\u00e0ria i qu\u00e8 ha d\u2019incloure?<\/h2>\n<p>Un <strong>contracte d\u2019intermediaci\u00f3 immobili\u00e0ria<\/strong> \u00e9s un acord entre una persona (compradora o venedora) i una ag\u00e8ncia immobili\u00e0ria, mitjan\u00e7ant el qual l\u2019ag\u00e8ncia es compromet a realitzar una s\u00e8rie de gestions per facilitar la compra o venda d\u2019un immoble a canvi d\u2019una remuneraci\u00f3 econ\u00f2mica.<br \/>\nEls contractes d\u2019intermediaci\u00f3 poden formalitzar-se tant per operacions de compravenda com per a lloguers.<\/p>\n<p>Els contractes d\u2019intermediaci\u00f3 immobili\u00e0ria a Catalunya es regulen principalment pel Decret 12\/2010, de 2 de febrer, que estableix els <strong>requisits per exercir com a agent immobiliari<\/strong> i crea el Registre d\u2019Agents Immobiliaris de Catalunya (AICAT). Tamb\u00e9 cal tenir en compte la Llei 3\/2017, integrada dins el Codi Civil Catal\u00e0. Aquesta llei estableix les normes sobre <a href=\"https:\/\/info.vivendex.com\/ca\/que-ha-de-contenir-un-contracte-darres\/\">com s\u2019han de redactar i complir els contractes d\u2019arres<\/a> i els contractes d\u2019intermediaci\u00f3 immobili\u00e0ria.<\/p>\n<p>Segons la normativa catalana, un contracte d\u2019intermediaci\u00f3 immobili\u00e0ria ha d\u2019incloure:<\/p>\n<ul>\n<li><strong>Identificaci\u00f3<\/strong> de les parts (client i ag\u00e8ncia).<\/li>\n<li><strong>Objecte del contracte<\/strong> (venda, lloguer, recerca d\u2019immoble, etc.).<\/li>\n<li><strong>Honoraris<\/strong> o comissions i moment de pagament.<\/li>\n<li><strong>Durada<\/strong> del contracte i condicions de renovaci\u00f3.<\/li>\n<li><strong>Obligacions<\/strong> de les parts.<\/li>\n<li><strong>Dret de desistiment<\/strong> (si escau). \u00c9s la facultat del client de cancel\u00b7lar el contracte sense justificar la seva decisi\u00f3 i sense penalitzaci\u00f3, sempre dins el termini legal establert.<\/li>\n<li><strong>Signatura<\/strong> d\u2019ambdues parts.<\/li>\n<\/ul>\n<h2>Qu\u00e8 \u00e9s una cl\u00e0usula abusiva?<\/h2>\n<p>Llavors, qu\u00e8 \u00e9s una cl\u00e0usula abusiva i com identificar-la en un contracte d\u2019intermediaci\u00f3 immobili\u00e0ria a Catalunya?<br \/>\nUna cl\u00e0usula abusiva \u00e9s aquella que <strong>imposa condicions injustes al consumidor<\/strong>, creant un desequilibri important entre els seus drets i els de l\u2019ag\u00e8ncia immobili\u00e0ria. Encara que estiguin signades, aquestes cl\u00e0usules <strong>no tenen validesa legal<\/strong>, ja que vulneren la bona fe i la protecci\u00f3 al consumidor.<\/p>\n<h3>Cl\u00e0usules abusives m\u00e9s comunes en contractes de compravenda<\/h3>\n<p>Entre les cl\u00e0usules immobili\u00e0ries m\u00e9s habituals en contractes de compravenda, destaquen:<\/p>\n<p><strong>Retenci\u00f3 abusiva de quantitats entregades com a reserva o arres<\/strong><\/p>\n<p><a href=\"https:\/\/info.vivendex.com\/ca\/particularitats-del-contracte-darres-a-catalunya\/\">A Catalunya, si s\u2019entreguen arres penitencials<\/a>, el comprador perd la quantitat si decideix no continuar amb la compra, i <strong>el venedor ha de retornar el doble<\/strong> si incompleix l\u2019acord. Aquesta pr\u00e0ctica vulnera el dret del consumidor a escollir lliurement els seus professionals de confian\u00e7a. Una ag\u00e8ncia pot recomanar serveis, per\u00f2 <strong>la contractaci\u00f3 mai no ha de ser obligat\u00f2ria.<\/strong><\/p>\n<p><strong>Limitaci\u00f3 de responsabilitat de l\u2019ag\u00e8ncia<\/strong><\/p>\n<p>Una ag\u00e8ncia immobili\u00e0ria no pot eludir la seva responsabilitat si facilita informaci\u00f3 incorrecta sobre l\u2019immoble o comet errors durant el proc\u00e9s de compravenda o lloguer. Aix\u00f2 contrav\u00e9 la llei i pot perjudicar el client. <strong>L\u2019ag\u00e8ncia ha d\u2019oferir dades clares i completes<\/strong> i, si causa un perjudici, el client t\u00e9 dret a reclamar.<\/p>\n<p><strong>Entrega de documentaci\u00f3 incompleta o amb retard<\/strong><\/p>\n<p>L\u2019ag\u00e8ncia ha de <strong>lliurar tots els documents obligatoris de l\u2019immoble<\/strong> (certificats energ\u00e8tics, c\u00e8dula d\u2019habitabilitat, Nota Simple&#8230;) de manera completa i a temps. Amagar o lliurar tard aquesta informaci\u00f3 \u00e9s una mala pr\u00e0ctica que pot causar problemes legals i fins i tot anul\u00b7lar la compravenda o el lloguer. El client t\u00e9 dret a rebre tota la documentaci\u00f3 abans de signar cap contracte.<\/p>\n<p><strong>Penalitzacions abusives per incompliment<\/strong><\/p>\n<p>Les sancions per incompliment del contracte (tant per part del comprador com del venedor) han de ser <strong>justes i equilibrades.<\/strong> No pot haver-hi penalitzacions molt elevades per a una part i gaireb\u00e9 cap per a l\u2019altra. El primer que cal comprovar \u00e9s que estigui inscrita al <a href=\"https:\/\/web.gencat.cat\/es\/tramits\/tramits-temes\/Registre_Agents_Immobiliaris_Catalunya\">Registre d\u2019Agents Immobiliaris de Catalunya (AICAT)<\/a>, la qual cosa assegura que compleix els requisits legals per oferir serveis immobiliaris a Catalunya.
