Encara que en aquest punt sembla que tot est\u00e0 resolt, \u00e9s habitual que els dies previs a la signatura sorgeixin dubtes d\u2019\u00faltima hora, especialment relacionats amb qu\u00e8 fer amb determinats elements de l\u2019habitatge. <strong>Qu\u00e8 he de deixar al comprador i qu\u00e8 puc endur-me?<\/strong><br \/>\nI si hi ha accessoris el dest\u00ed dels quals no est\u00e0 del tot clar?<\/p>\n<p>Per resoldre aquests dubtes, vegem qu\u00e8 diu la llei al respecte:<\/p>\n<h2>Qu\u00e8 diu la llei que cal deixar en vendre?<\/h2>\n<p>Segons l\u2019article 1097 del Codi Civil, la principal <strong>obligaci\u00f3 del venedor en una compravenda \u00e9s lliurar la cosa<\/strong>, en aquest cas, l\u2019habitatge. Per\u00f2, qu\u00e8 passa amb cadascun dels accessoris que hi ha dins? Electrodom\u00e8stics, mobles, aire condicionat&#8230; Cal entregar-los tamb\u00e9 amb la casa?<\/p>\n<p>En realitat, <strong>la llei no fixa res sobre aquesta q\u00fcesti\u00f3.<\/strong><br \/>\nTot i aix\u00ed, abans de determinar qu\u00e8 deixar i qu\u00e8 no al comprador, \u00e9s important parar atenci\u00f3 a aquestes q\u00fcestions:<\/p>\n<p><strong>Qu\u00e8 has anunciat com a part del pis?<\/strong><br \/>\nSi a la descripci\u00f3 de l\u2019habitatge vas mencionar que la propietat comptava amb aire condicionat i cuina completament equipada, s\u2019ent\u00e9n que formen part de la venda i, per tant, s\u2019han de quedar.<\/p>\n<p><strong>Qu\u00e8 has acordat al contracte d\u2019arres i de compravenda?<\/strong><br \/>\nTot el que s\u2019acordi entre venedor i comprador durant les negociacions pr\u00e8vies a la signatura, s\u2019ha d\u2019incloure per escrit en el contracte d\u2019arres i en el posterior contracte de compravenda. Per exemple, si al contracte s\u2019hi indica que el venedor s\u2019endur\u00e0 els electrodom\u00e8stics, el comprador no podr\u00e0 reclamar-los m\u00e9s endavant.<\/p>\n<h6><a href=\"https:\/\/info.vivendex.com\/ca\/contracte-arres\/?utm_source=Blog&#038;utm_medium=CTA&#038;utm_campaign=modelo_contrato_arras_ca&#038;utm_gen=utmdc\">Model de contracte d\u2019arres<\/a><\/h6>\n<h2>Elements que has de deixar en vendre<\/h2>\n<p>Un cop considerat l\u2019anterior, detallem quins s\u00f3n els elements m\u00e9s comuns que el venedor sol deixar al seu habitatge abans d\u2019entregar les claus al comprador:<\/p>\n<ul>\n<li><strong>Instal\u00b7lacions fixes:<\/strong> llums de sostre, aplics, barres de cortines, miralls encastats&#8230;<\/li>\n<li><strong>Sistema de calefacci\u00f3 i aire condicionat<\/strong> si est\u00e0 encastat o instal\u00b7lat de forma fixa.<\/li>\n<li><strong>Armaris encastats<\/strong> i mobles fets a mida.<\/li>\n<li><strong>Persianes, tendals i estors.<\/strong><\/li>\n<li><strong>Term\u00f2stats, <\/strong>videoporters i dispositius de dom\u00f2tica connectats a la infraestructura.<\/li>\n<li><strong>Elements del bany<\/strong> com lavabos, sanitaris, mampares o mobles de bany fixats.<\/li>\n<li><strong>Electrodom\u00e8stics integrats:<\/strong> forn, campana extractora, placa vitrocer\u00e0mica&#8230; Tamb\u00e9 conv\u00e9 deixar totes les instruccions d\u2019aquests electrodom\u00e8stics si encara es conserven.<\/li>\n<\/ul>\n<h2>Elements que pots endur-te en vendre<\/h2>\n<p>Tot el que <strong>no estigui fixat de forma permanent<\/strong> a l\u2019habitatge ni s\u2019hagi pactat expressament, el venedor se\u2019l pot endur. Ens referim a:<\/p>\n<ul>\n<li><strong>Objectes personals i decoratius:<\/strong> gerros, marcs, llibres, catifes, roba, vaixella, llibres&#8230;<\/li>\n<li><strong>Electr\u00f2nica i tecnologia no integrada:<\/strong> televisors, altaveus, routers&#8230;<\/li>\n<li><strong>Roba, articles de cuina i estris personals.<\/strong><\/li>\n<li><strong>Plantes i testos<\/strong> que no estiguin plantats a terra o ancorats.<\/li>\n<li><strong>Petits electrodom\u00e8stics<\/strong> com cafeteres o robots de cuina.<\/li>\n<\/ul>\n<h2>Qu\u00e8 passa si hi ha dubtes o malentesos?<\/h2>\n<p>La llei no deixa del tot clar qu\u00e8 s\u2019ha de deixar o no quan es ven un habitatge, per la qual cosa els dubtes i malentesos entre compradors i venedors solen ser habituals. En aquest sentit, comptar amb el suport d\u2019una ag\u00e8ncia immobili\u00e0ria pot ajudar, no nom\u00e9s a prevenir, sin\u00f3 tamb\u00e9 a resoldre aquest tipus de conflictes quan ja han tingut lloc.<\/p>\n<p><strong>Com pot una ag\u00e8ncia immobili\u00e0ria evitar aquest tipus de malentesos?<\/strong><\/p>\n<ul>\n<li>Elaborant un <strong>anunci<\/strong> en qu\u00e8 es manifestin clarament els elements que el venedor deixar\u00e0 en lliurar l\u2019habitatge.<\/li>\n<li><strong>Fent de mitjancera durant les visites<\/strong> per informar amb precisi\u00f3 el comprador sobre qu\u00e8 elements deixar\u00e0 el venedor a l\u2019habitatge i quins s\u2019endur\u00e0.<\/li>\n<li><strong>Incloent cl\u00e0usules espec\u00edfiques<\/strong> tant al contracte d\u2019arres com al de compravenda per indicar quins s\u00f3n els elements que s\u2019entregaran amb l\u2019habitatge.<\/li>\n<\/ul>\n<p><strong>Com pot una ag\u00e8ncia immobili\u00e0ria resoldre aquest tipus de malentesos?<\/strong><br \/>\nTot i aix\u00f2, a vegades \u00e9s inevitable que aquests malentesos es produeixin, b\u00e9 perqu\u00e8 una de les parts est\u00e0 confosa sobre el que s\u2019ha acordat, o b\u00e9 perqu\u00e8 no s\u2019ha definit del tot b\u00e9 des del principi.
